Yaffe sues Pentagon over 2008 scrapyard fatality

Yaffe Cos. Inc. has filed a lawsuit against the Defense Department, asserting the agency is liable for the death of a temporary employee who was using a torch to remove brass loops from steel projectiles.

The temporary worker, Stephen Fontenot, died from injuries sustained when a supposedly inert ammunition shell exploded at a Yaffe branch scrapyard in Arkoma, Okla., in November 2008 (AMM, Nov. 20, 2008).

The Yaffe lawsuit, filed on Friday in U.S. District Court for the Eastern District of Oklahoma, said $5 million should be the tentative Defense Department liability to the scrap processor, anticipating the possibility of the family winning its state court suit against the company.....
