Memphis tag-and-hold law ‘looking to shut down yards’

Lawyers for Tennessee recyclers have urged an appeals court to look closely at a recent filing by theft victims as unintended evidence that a Memphis tag-and-hold ordinance aims "to put scrap metal recyclers in Memphis out of business altogether."

Memphis city officials successfully defended a 10-day embargo on mingling and selling newly purchased scrap before the U.S. District Court. The city's recent appellate brief focuses mostly on how to interpret certain parts of the Constitution.....
