Court rejects ethnic claims against scrapyard, workers

A federal court has dismissed ethnic intimidation claims against Kalamazoo Metal Recyclers Inc. (KMR) and its workers, who detained three Hispanic men they suspected of trying to steal metal from the scrap company in August 2006.
U.S. District Court Judge Gordon J. Quist dismissed the claims filed by Jose Guadalupe Prieto, Adan Juarez and Eduardo Romero, who were among six men bound, threatened and assaulted by the scrapyard's owner and his workers.
The three Hispanic men had filed suit in U.S. District Court for the Western District of Michigan alleging that KMR and various individuals—its owner, Patrick J. Farrell Sr.; his sons, Patrick J. Farrell Jr. and William J. Farrell; and several of the scrapyard's workers—had conspired to deprive them of their federal constitutional rights and violated Michigan's ethnic intimidation statute.....
