Appeals court overturns ruling on cleanup

A federal appeals court has overturned a lower court ruling that absolved several lead scrap suppliers of responsibility for cleanup costs at a now-defunct California lead smelter.

The U.S. Court of Appeals, Ninth Circuit, reversed a summary judgment by the U.S. District Court for Central California and sent the case involving Alco Pacific Inc. and its suppliers of lead scrap back to the lower court for a new trial. Alco Pacific was a lead smelter in Carson, Calif., that processed auto batteries, wheel weights and lead slag and dross from 1950 until 1990, producing lead ingots that were sold to other companies.....
