Stainless plate import ruling reversed

NEW YORK — The U.S. Court of Appeals has reversed a ruling by a lower court that imports of stainless steel plate in coil from Aperam Stainless Belgium N.V. were within an existing anti-dumping duty order.

The duties date back to 1998, when petitioners Allegheny Ludlum Corp., AK Steel Corp. and other domestic stainless interests petitioned for dumping and subsidy duties on the product from Belgium. While subsidy duties on the Belgian product were revoked in 2011, the Belgium-wide anti-dumping rate of 8.54 percent remained.

In 2007, Aperam Belgium, a division of Luxembourg-based ArcelorMittal SA formerly known as ArcelorMittal Stainless Belgium N.V., requested a scope ruling to determine whether its products, with a nominal thickness of 4.75 millimeters or more when ordered but shipped into the United States with actual thicknesses less than 4.75 mm, were included in the scope of the order.....
