Court upholds decision on unauthorized excavator use

PITTSBURGH An Ohio scrapyard owner will not be reimbursed for damages a firefighter allegedly caused to the recyclers equipment while putting out a fire in October 2010.
Christopher Bates, owner of Cygnet, Ohio-based Bates Recycling Inc., sued the Village of Cygnet Fire Department and firefighter Andy Socie, claiming that Socie damaged a Caterpillar excavator he used without authorization to help fight the fire.
An Ohio appellate court upheld a September 2011 judgment issued by Wood County (Ohio) Court of Common Pleas dismissing Bates claims.....
