Deacero challenges Commerce decision

NEW YORK – Mexican steelmaker Deacero SA de CV has challenged a determination by the Commerce Department that imports of 4.75-millimeter steel wire rod from Mexico are subject to the same dumping duties as 5-mm material.

The complaint, filed earlier this week at the U.S. Court of International Trade (CIT), alleges that 4.75-millimeter rod was not available in the U.S. market and therefore should not be part of the original dumping order on 5- to 19-mm material.
 
“The Department determined that 4.75 mm wire rod constitutes a minor alteration...even though the product was commercially available before the original anti-dumping investigation of steel wire rod from Mexico, and was not included in the scope of the anti-dumping duty order,” according to the complaint. “Therefore, the Department’s affirmative final anti-circumvention determination is not in accordance with law.” ....
