NEW YORK All Metal Sales Inc. is suing GKN Aerospace New England Inc. for allegedly withholding payment for metal shipments valued at nearly $140,000.
GKN subsidiary Teleflex Aerospace Manufacturing Group, which produces engineered products for the aerospace, industrial and other sectors, received eight shipments from All Metal Sales in March, April and May 2007, according to the suit filed in U.S. District Court in Ohio.
After Manchester, Conn.-based Teleflex received and paid for the first two shipments, the company asked All Metal Sales to extend the terms of the sale by 30 days, then informed All Metal Sales in July 2007 that payment would be delayed until one of its own customers placed an order or refused goods, according to the lawsuit.
Westlake, Ohio-based All Metal Sales claims it had received no payment or information by November 2008 and issued the company a bill for $139,569. "Despite the fact that (All Metal Sales) has fully performed, Teleflex has failed to pay plaintiff for the materials and, therefore, Teleflex has breached its contract," according to the lawsuit.
GKN Aerospace is a division of United Kingdom-based global engineering group GKN Plc.
Attorneys for GKN and All Metal Sales could not be reached for comment.
