NEW YORK — Union Pacific Railroad Co. has brought a $118,000 lawsuit against AFCO Steel LLC for allegedly failing to pay extra charges it accrued while holding onto Union Pacific’s delivery rail cars for longer than the parties had agreed.

AFCO requested freight shipments from the railroad franchise that were delivered in July and August 2011, according to the lawsuit, but AFCO allegedly didn’t accept deliveries of some rail cars and didn’t return them within the permitted time frame.

Omaha, Neb.-based Union Pacific claims that AFCO is obligated to pay demurrage charges on the cars of $117,840.

"Despite Union Pacific’s demand for payment, AFCO has failed and refused to satisfy the charges and has unpaid debt to Union Pacific," according to the suit.

Little Rock, Ark.-based AFCO and sister company W&W Steel LLC have supplied projects such as the 9/11 Memorial Museum Pavilion in New York and Cowboys Stadium in Dallas.
