NEW YORK Bradford Steel Co. Inc. has sued contractor K-Con Inc. for allegedly failing to pay for steel structures that the company supplied for an Air National Guard facility in Cape Cod, Mass.
K-Con hasnt paid the more than $74,000 it owes Bradford Steel for steel structures received for the project at Otis Air Force Base, according to court documents filed Wednesday in U.S. District Court in Massachusetts.
K-Con, North Charleston, S.C., was contracted by the federal government to secure labor and materials for the project. K-Con and Bradford Steel, East Freetown, Mass., entered into a subcontract in November 2010 worth $282,186, according to the lawsuit.
"You can only wait so long before you get paid," Bradford Steel president Brian Jackson told AMM.
K-Con paid for part of the supplies, but still owes Bradford Steel $74,146 and has refused to pay the balance, the lawsuit states.
Bradford Steel has asked the court to award the remainder of the alleged nonpayment, as well as interest and costs and any further judgment it deems fit to apply, the lawsuit states.
K-Con could not be reached for comment.
