Obsolete Nucor unit files suit vs. fabricator

NEW YORK — Nucor Wire Products Pennsylvania Inc. has filed a lawsuit against fabricator Rack & More LLC for allegedly failing to pay for wire decking.

Orlando, Fla.-based Rack & More applied for credit from Nucor last June and ordered four shipments of wire decking from the steelmaker, according to the lawsuit filed in U.S. District Court in Pennsylvania.

Nucor said it billed the company four times for amounts ranging from $16,005 to $21,375 last summer, but Rack & More did not submit any payments. "(The) defendant did not make timely payments to Nucor for the amounts set forth in any of the invoices," according to the lawsuit.

Charlotte, N.C.-based Nucor is suing Rack & More for a total of $76,565 plus interest and attorneys’ fees.

Nucor sold New Salem, Pa.-based Nucor Wire Products Pennsylvania to an affiliate of Wire Mesh Corp. in August 2012 (, Aug. 24). The lawsuit was filed under the now-obsolete company’s name.

Attorneys for Nucor did not respond to calls for comment. The president of Rack & More, Bill Radler, declined to comment.
