Man gets 18 months’ jail for scrap heist from CSX yard

PITTSBURGH — The first of four New York men convicted of stealing processed scrap metal en route to a Pennsylvania steel mill has been sentenced to 18 months in prison and ordered to pay $4,669 in restitution.

Anthony Toscano of Rochester, N.Y., who had been facing up to 10 years in prison and a $250,000 fine, has been ordered to turn himself in on July 5. He could not be reached for comment.

Toscano is one of four men convicted in U.S. District Court in New York of conspiracy to steal an interstate shipment and theft of an interstate shipment (, Oct. 12). Two of the other three men are scheduled to be sentenced next month and the third in September.

The group used a logging truck in 2009 to remove more than 16 gross tons of baled scrap from a CSX Transportation Inc. facility in Batavia, N.Y., according to court documents.
