NEW YORK A valve product assembled in the United States using some Indian parts qualifies as a U.S. product and can be bought by the government under Buy America laws, U.S. Customs and Border Protection has ruled.
Omni Valve Co. LLC requested the ruling on its OmniSeal DBB valve, a plug-type valve used in fuel storage and disbursing systems. The Muskogee, Okla.-based company purchases the valve body from India and adds an automatic differential thermal relief system at its Oklahoma facility.
Omni Valve "substantially transformed the foreign body valve into a product of the United States for purposes of U.S. government procurement," Sandra L. Bell, executive director, regulations and rulings, at the Office of International Trade, wrote in a June 27 Federal Register notice. "The number of parts assembled, including significant numbers of U.S.-origin parts, and the relative complexity of the operations carried out, indicate that the imported components have undergone a substantial transformation by reason of the operations carried out in the United States."
The valves are to be offered to the U.S. government "under an undesignated government procurement contract," Bell said.
Omni Valve declined to discuss the ruling, and its lawyers could not be reached for comment.
