USA Metal Recycling sued over bill dispute

PITTSBURGH — An equipment service provider is suing a metal recycler for allegedly not paying for repairs to an auto shredder.

Sargents Equipment & Repair Services Inc., South Chicago Heights, Ill., is suing Lowell, Ark.-based USA Metal Recycling LLC for breach of contract, according to a complaint filed in Cook County (Ill.) Circuit Court.

Sargents said it began making repairs to the shredder in August 2013 after reaching an oral agreement with USA Metal Recycling. It billed the recycler nearly $290,000 in seven installments but alleges it is still owed almost $115,600 for four unpaid invoices.

The recycler told Sargents via e-mail in February that the unpaid portion would be paid, but it has not yet done so, according to court documents.

USA Metal Recycling, which could not be reached for comment, earlier this month petitioned the U.S. District Court in Illinois to have the case transferred to federal court.
