Judge rules against ASR in patent lawsuit

PITTSBURGH — A manufacturer of a scrap metal container loading system has prevailed in a court case after a judge determined that the company did not infringe on a patent.

The decision settles a lawsuit filed more than two years ago by Advanced Steel Recovery LLC (ASR) against Rocklin, Calif.-based X-Body Equipment Inc. (, May 7, 2012).

Judge Garland E. Burrell Jr. issued a summary judgment in U.S. District Court in California that the construction of X-Body’s Acculoader does not infringe on Fontana, Calif.-based ASR’s Container Packer System and Method patent.

"The court has made its decision and the Acculoader does not infringe on anyone’s patent. ... There is now another option in the marketplace for container loading," X-Body president Greg Bushong said.

ASR could not be reached for comment.
