Nucor Fastener challenges ITC ruling that US industry not injured by imports

Nucor Fastener has filed an appeal with the U.S. Court of International Trade, claiming the U.S. International Trade Commission (ITC) erred in ruling that the domestic fastener industry is not being injured by dumped and subsidized imports from China and Taiwan.
Alan Price, partner in the international trade practice of Washington law firm Wiley Rein LLP, called the decision "clearly erroneous."
Price, counsel to Nucor Fastener, was sharp in his criticism of the ITC ruling and minced no words in announcing the appeal and his client's intent to vigorously pursue the case.
"The ITC's determination that the U.S. fasteners industry is uninjured is arbitrary, capricious, an abuse of discretion and otherwise not in accordance with law," Price said. "The evidence clearly showed that the industry's operating margins dropped by more than 50 percent and that Chinese and Taiwanese fasteners dramatically undersold U.S.-produced fasteners."....
